Please read these Terms and Conditions carefully before accessing or using the Calofay Service.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings assigned to them in this Section or otherwise defined in these Terms. The definitions apply regardless of whether the terms appear in singular or plural.

1.2 Definitions

Affiliate — Means any entity that controls, is controlled by, or is under common control with the Company.

Application — Means the mobile application titled "Calofay: AI Calorie Counter," including all related features, tools, content, and updates.

Company, We, Us, or Our — Means Calofay, operated by Evana Care LLC, located at 30 North Gould Street, Sheridan, WY 82801, United States.

Device — Means any device capable of accessing the Service.

Service — Means, collectively, the Application, associated software, features, content, algorithms, and services provided by the Company.

User Content — Means any images, text, food logs, nutrition entries, metadata, or other content uploaded or submitted by You through the Service.

You — Means the individual using the Service.

2. Agreement to Terms

Your access to and use of the Service is conditioned upon Your acceptance of these Terms and the Calofay Privacy Policy. By accessing or using the Service, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree to these Terms, You must discontinue use of the Service.

3. Eligibility; Age Requirements

You represent and warrant that You are at least 13 years old. If You are between 13 and 17 years old, You may only use the Service with the supervision and consent of a parent or legal guardian.

4. Health, Nutrition, and Safety Disclaimer

Calofay does not provide medical advice, nutritional counseling, or professional healthcare services. All calorie calculations, nutrition estimates, and recommendations provided by the Service are informational approximations only.

  • Calorie and nutrition estimates may not be fully accurate.
  • The Service is not intended to diagnose, treat, cure, or prevent any disease.
  • You should consult qualified healthcare professionals for medical or dietary advice.
  • The Company is not responsible for any decisions made based on information provided by the Service.

5. User Content; License Grant

By submitting User Content through the Service, You represent that You own or have the necessary rights to submit such content. You grant the Company a worldwide, royalty-free, transferable, sublicensable license to use, store, reproduce, analyze, process, and modify User Content solely for the purpose of operating, maintaining, and improving the Service. You agree not to upload or submit content that is unlawful, offensive, harmful, or infringes upon the rights of others.

6. Prohibited Uses

  • Upload unlawful, harmful, or abusive content
  • Attempt to reverse engineer the Service
  • Access the Service for competitive analysis
  • Circumvent security protections
  • Interfere with the Service's functionality
  • Use the Service for illegal activities

7. Subscriptions, Billing, and In-App Purchases

Subscriptions and in-app purchases may be processed through third-party platforms such as Apple App Store and Google Play Store. Payments, subscription renewals, cancellations, and refunds are governed by the policies of these platforms. Subscriptions may automatically renew unless canceled before the renewal date.

8. Third-Party Services

The Service may include links or integrations with third-party services. The Company is not responsible for the content, privacy policies, or practices of third-party services.

9. Intellectual Property

All intellectual property rights in the Service, including software, design, algorithms, and content (excluding User Content), are owned by the Company or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without written permission.

10. Termination

The Company may suspend or terminate Your access to the Service at any time if You violate these Terms. Upon termination, Your right to use the Service immediately ceases.

11. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. The Company disclaims all warranties including accuracy, reliability, fitness for a particular purpose, non-infringement, and merchantability.

12. Limitation of Liability

To the maximum extent permitted by law, the Company's total liability shall not exceed the greater of:

  • The amount You paid for the Service during the previous 12 months, or
  • One hundred dollars (USD $100).

The Company shall not be liable for indirect, incidental, or consequential damages including loss of profits, data, or service interruption.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

14. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Failure to enforce any provision shall not constitute a waiver of that provision.

15. Changes to These Terms

The Company may update these Terms periodically. Changes will become effective once posted within the Application or Service. Continued use of the Service after updates constitutes acceptance of the revised Terms.
